例外的事例ながら、特定技能1号が定住者5号の在留資格認定証明書を得られました!

先日、ベトナム人男性(20歳代)の「 #定住者5号ロ#在留資格認定証明書を得ることができました

この男性は #技能実習 でその後、#特定技能1号 で在留し働いていました。

日本で #定住者 であるフィリピン人女性と知り合い結婚をすることとなったわけですが…

特定技能1号は #家族滞在 が不可であるため、結婚も不可と思われがちです。しかし結婚自体は可能ですし、夫婦互いが独立性ある在留資格があれば問題ないのです。

しかしこのベトナム人男性の場合、フィリピン人定住者女性との結婚について #登録支援機関 に相談したところ、支援の打ち切りを言い渡され「結婚をするなら特定技能として日本にはいられないし、支援もできない。」と言われたとのこと。

明らかに登録支援機関の見解は間違っています。しかし彼は身近な日本人支援者から見捨てられた形となってしまったのです。

残されたのは若いベトナム人とフィリピン人のカップル。

ただ定住者フィリピン人女性が属する派遣会社の日本人スタッフから「 #在留資格 (#VISA )の問題さえ解決できるなら、当社で夫となるベトナム人男性の職も紹介はできる。」と励まされたようです。

そして弊所 #行政書士事務所_VERDE を訪ねて来られ受任した訳ですが…

ただ紆余曲折あって時間が経過してしまってからのスタートであったため、ベトナム人男性の在留期限が残り少なかった点。

そして弊所の初動の際、肝心の当事者から必要な情報を提供されなく、時間的に不可能な状況となってから追加情報が来る、という有り様で…

恐らく複雑な事情を解決するには、事務行程の増加によって弊所への報酬額が掛かると、話をシンプルに見せ掛けようとしたようです。そういう誤魔化しに似た手法では、とても当方は責任が持てませんし在留資格は得られません。

結局、夫:ベトナム人男性は在留期限到来により本国に帰国。そのベトナムにて両人の挙式を行い、ベトナム政府とフィリピン政府に婚姻届を提出したのですが…

何故かフィリピン本国には赴かず、在ベトナムフィリピン領事館へ…

ここでフィリピン領事館から受理書は発行されたのですが…

これが出入国在留管理局では問題視されてしまう結果となり、認定許可が更に遅れるというか下りないかもしれない事態を誘発してしまいました。

我が国の出入国在留管理局は、今回のようなケースはフィリピン政府発行の公的証明書面を提出することを基本としています。しかしその書面を全く信用していません。

それ以前にフィリピン政府発行の婚姻証明書(PSA)の発行自体が困難としてしまった、という問題が障壁となるのですが…

これも結果的に本人たちが小職に相談なしに、ただ早く新婚生活を始めたい気持ちが先行し行動してしまったがために起きたことで…

そこでご両人から再度全て話すように諭し、漸く全容が把握できたところで出入国在留管理局に相談。相談というより交渉に近い内容となりました。その結果、欠けてしまう疎明資料に関し小職が作成する「理由書」次第で可否が決まる、という流れを作りました。

そして、漸く定住者5号ロを前提とした在留資格認定証明書の発行に繋がりました。

これだけトラブル等々ありながら、申請から許可までは4か月。早い部類だと思います。

Although this is an exceptional case, we were able to obtain a Certificate of Eligibility for Long-term Resident No. 5 for a person with Specific Skill No. 1!

The other day, I was able to obtain a #Certificate of Eligibility for #Long-Term Resident #5 for a Vietnamese man (in his 20s).

This man came to Japan as a #technical intern and then changed his status of residence to #Specified Skilled Worker No. 1 and started working there.

While doing so, he met and married a Filipino woman who was a “long-term resident” in Japan…

Specified Skilled Worker No. 1 is not allowed to stay with his family, so it is often thought that he is not allowed to get married. However, marriage itself is possible, and there is no problem as long as both husband and wife have independent residence statuses.

However, in the case of this Vietnamese man, when he consulted with a #registered support organization about marrying a Filipino female resident, he was told that their support would be discontinued, saying, “If I were to get married, I would not be able to come to Japan as a specified skilled worker, and I would not be able to receive support.” ” was said to have been said.

Clearly, the opinion of the registration support organization is wrong. However, he ended up being abandoned by his closest Japanese supporters.

What was left behind was a young Vietnamese and Filipino couple.

However, a Japanese staff member at the temporary staffing agency to which the Filipino woman is a permanent resident encouraged her and said, “If you can resolve the issue of #residence status (#VISA), we can introduce you to a job at our company for a Vietnamese man who will become your husband.” It seems that.

However, there were many twists and turns, and the project started after some time had passed, so there wasn’t much left until the Vietnamese man’s period of stay.

During our initial response, we were not provided with the necessary information by the most important parties, and additional information came only after the situation became impossible due to time constraints.

It seems that they were trying to make the matter look simple, saying that resolving a complex situation would require more administrative work and would cost us more. If we use a method similar to such deception, we cannot take responsibility and we will not be able to obtain a status of residence.

In the end, my husband, a Vietnamese man, returned to his home country due to the expiry of his stay in Japan. We held a wedding ceremony in Vietnam and submitted marriage registration to the Vietnamese and Philippine governments…

For some reason, I didn’t go to the Philippines itself, but instead went to the Philippine Consulate in Vietnam…

A certificate of receipt of the notification was issued by the Philippine Consulate here, but…

This ended up being viewed as a problem by the Immigration Bureau, leading to a situation where the approval was further delayed or even not granted at all.

Japan’s Immigration Bureau basically requires submission of official certification documents issued by the Philippine government in cases like this one. But I don’t trust that document at all.

Before that, the problem was that it was difficult to issue a marriage certificate (PSA) issued by the Philippine government.

This also happened because the people themselves acted without consulting me, just because they wanted to start their newlywed life as soon as possible.

So I advised both of them to tell me everything again, and when I finally understood the whole story, I consulted the Immigration Bureau. It turned out to be more like a negotiation than a consultation. As a result, we created a flow in which the approval or rejection of the missing explanatory materials would depend on the “statement of reasons” that I prepared.

After such hardships, we were finally able to issue a Certificate of Eligibility for Resident Status for long-term residents (No. 5).

Despite all these troubles, it only took 4 months from application to approval. I think the speed at which you can get permission is much faster than average.
